Tighten control of overloaded vehicles transporting goods

VCN – The General Department of Vietnam Customs (GDVC) has directed local Customs Departments to continue strengthening the control of overloaded and oversized vehicles transporting goods that are subject to customs supervision.

The General Department of Vietnam Customs requested local Customs Departments to strictly comply with the provisions of the law and the direction of GDVC. At the same time, notifying to enterprises operating warehouses, yards and ports to coordinate in the implementation; strengthening inspection of performance to promptly detect, correct, and handle cases of improper implementation of regulations.

If domestic authorities check and detect that vehicles violated the regulations on overloading and oversized vehicles, vehicles carrying homemade containers “fake containers” are sealed and cleared by the customs authority and circulated on the road, leaders of customs branches and civil servants related to the implementation of customs procedures for these means of transport will be responsible.

In case enterprises operating warehouses, yards or ports intentionally allow means of transport that violate regulations on overloading and oversized vehicles, means of carrying homemade containers “fake containers” to transport goods through the customs supervision area, the enterprise is responsible in accordance with the provisions of law.

In addition, GDVC also provides guidance for cases where vehicles for transport of oversize/overweight loads that are allowed by competent authorities to transport oversize/overweight loads.

Previously, at the end of 2022, GDVC directed units not to handle entry clearance procedures, or customs seal for vehicles transporting goods that exceed the designed weight as stated in the vehicle registration certificate, exceed the load capacities allowed to be transported as stated in the certificate of technical safety and environmental protection of the vehicle; only carry out customs seal and confirm that goods are eligible to pass through customs supervision area for containers with goods subject to customs supervision that meet the conditions of customs seal and supervision, standards of container size specified in Circular No. 64/2015/TT-BGTVT dated November 5, 2015 of the Ministry of Transport.

For casea of vehicles transporting oversize/overweight loads having a license issued by the competent authority, it will be allowed to load goods onto the means of transport and certified to pass through the customs supervision area if the means of transport satisfy the conditions for vehicles for the transport of oversize/overweight loads and the conditions for the circulation of vehicles on roads as prescribed in Circular No. 46/2015/TT-BGTVT dated September 7, 2015 of the Ministry of Transport.
