Saigon Port Area III Customs Branch, Ho Chi Minh City Customs Department has just issued a Notice to the Immigration Department under the Ministry of Public Security requesting to postpone the exit of Ms. Luong Tieu Tran, born in 1979, Director Saigon Port Service and Import Export JSC (address: 215 – 217 Tran Hung Dao, Co Giang Ward, District 1, Ho Chi Minh City, tax code: 0302976687).

Ms. Luong Tieu Tran is the legal representative of the company. She is being forced to implement an administrative decision on tax management and has not yet fulfilled its tax payment obligation according to Enforcement Decision No. 75/QD-KVIII dated November 14, 2013 of Saigon Port Area III Customs Branch on enforcement of administrative decisions on tax management by stopping customs procedures for exported and imported goods. The tax amount subject to enforcement is over VND34.6 billion.

The exit suspension period is from May 14, 2024 until the taxpayer fulfil her tax obligation to the State budget.

Previously, on November 14, 2023, Saigon Port Area III Customs Branch issued a decision to enforce by stopping customs procedures for exported and imported goods of Saigon Port Import-Export and Services JSC.

This enforcement decision is to implement Notice No. 182/TB-KVIII dated November 8, 2023 on taxes, late payment interest, and outstanding fines of Saigon Port Area III Customs Branch with a total amount of over VND34.6 billion. The enforcement decision is effective for one year from November 21, 2023.

The above tax debt amount arises from the investigation conclusion of the Police agency. Accordingly, from 1999 to 2004, Nha Rong Port Duty Free Store belonging to Saigon Port Import-Export and Services JSC committed to act of illegal trading of duty-free goods to the wrong people, contrary to

State’s regulation, including: 26,790 packs of foreign cigarettes and 47,558 bottles of foreign wine; 23,107 cans of beer, causing great damage to the State budget.

In December 2006, the Director of the Supreme People’s Procuracy issued Indictment No. 13/VKSTC-V1 determining that Nha Rong Port Duty Free Store had sold goods to the market illegally, causing tax losses of over VND32 million on alcohol and cigarettes (excluding beer).

However, in October 2007, the Director of the Supreme People’s Procuracy issued a decision to suspend the criminal case and switch to administrative sanctions for the act of selling imported tax-free cigarettes, alcohol, and beer tax-free to the market due to insufficient evidence to constitute a criminal case.

Due to the illegal act of selling tax-free goods to the domestic market, according to the authority, the Customs agency must collect tax. To handle the above case, the Ho Chi Minh City Customs Department held many meetings with relevant parties, and based on the results of the tax assessment solicitation of the Supreme People’s Procuracy for the wrongly sold goods, to issue a decision on tax assessment on three items, including: cigarettes, alcohol, and beer, totaling more than VND33 billion.

After issuing the tax assessment decision, the Customs office received a written explanation from the company about the tax amount, and appealed against the two tax assessment decisions. However, the Customs agency still maintains its view of collecting more than VND33 billion in taxes for this company.

For many years, although the Customs agency has repeatedly urged, sent notice of debt and invite the representative of the company to work with customs but there have been no results.
